Welcome to DimePath.com (the "DimePath," "Service," "we," "us," or "our"). The Service is owned and operated by Hello Favors, LLC. These Terms of Service ("Terms") govern your use of our website located at www.dimepath.com and any related services provided by us.

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

DimePath provides a platform for users to discover, browse, and find information about self-published digital books ("Digital Books").

Currently, our Service primarily aggregates listings of Digital Books and provides links to third-party websites (such as Amazon Kindle Direct Publishing (KDP) and other ebook retailers, hereafter "Third-Party Retailers") where you can purchase these Digital Books. In this model, DimePath does not directly sell, host, or distribute Digital Books. All transactions, fulfillment, delivery, and customer service related to the purchase of Digital Books via these links are handled by the respective Third-Party Retailers.

In the future, DimePath may evolve to offer Digital Books for direct purchase on the Service (e.g., through an integrated e-commerce platform like Shopify). In such cases, Hello Favors, LLC would be the seller of record for those direct transactions. The terms applicable to direct purchases, including payment, delivery, and refunds, will be clearly presented at the point of sale and will supplement these general Terms.

3. User Accounts

Currently, DimePath does not require users to create an account to browse and access information on the Service. If we introduce features requiring account registration in the future, you will be required to provide information that is accurate, complete, and current. You would then be responsible for safeguarding your account credentials and for all activities under your account. We will update these Terms accordingly if account registration becomes a feature.

4. Use of the Service and Content

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation.
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm Hello Favors, LLC or users of the Service or expose them to liability.

The content on our Service, including book descriptions, cover images, and other related information, is provided for informational purposes. While we strive for accuracy, we do not warrant that all information is complete, reliable, or current, especially information sourced from or related to Third-Party Retailers.

5. Purchases and Third-Party Retailers

5.1. Purchases via Third-Party Retailers (e.g., KDP/Amazon):
When DimePath provides links to Third-Party Retailers, your interactions and transactions with those Third-Party Retailers are solely between you and the Third-Party Retailer. These are governed by their respective terms of service and privacy policies. Hello Favors, LLC is not responsible or liable for any aspect of your dealings with Third-Party Retailers, including but not limited to the purchase process, pricing, payment, delivery, refunds, quality of the Digital Books, or customer support.

Affiliate Disclosure: DimePath may participate in affiliate marketing programs, such as Amazon Associates. This means we may earn a commission if you click on certain links on our Service and make a purchase from a Third-Party Retailer. This commission comes at no additional cost to you and helps support the operation of our Service.

5.2. Direct Purchases on DimePath (Future):
If and when DimePath offers Digital Books for direct sale on our platform:

  • Hello Favors, LLC will be the seller of record.
  • Specific terms regarding payment methods, pricing, taxes, delivery mechanisms (e.g., direct download), and refund policies for such direct sales will be provided at the time of purchase and will form part of your agreement with us for that transaction.
  • Unless otherwise stated for direct purchases, all sales will be considered final.

6. Intellectual Property Rights

The Service and its original content (excluding content provided by third parties such as book cover images, descriptions, and author information), features, and functionality are and will remain the exclusive property of Hello Favors, LLC and its licensors. Our trademarks (DimePath, DimePath.com) and trade dress may not be used in connection with any product or service without our prior written consent.

Digital Book titles, cover art, excerpts, author names, and other related materials are the intellectual property of their respective owners (e.g., authors, publishers) and are displayed on DimePath for informational and promotional purposes, often provided by or licensed from these third parties or their distributors.

7. Data Privacy and Tracking Technologies

Your privacy is important to us. We use Google Tag Manager (GTM) to manage and deploy marketing tags and tracking pixels on our website, including those from Meta (Facebook), Pinterest, and TikTok. The use of these technologies and our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using the Service, you consent to such collection and use in accordance with our Privacy Policy.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Hello Favors, LLC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING BUT NOT LIMITED TO THE ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE OR ANY CONTENT OR INFORMATION FOUND THEREON.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

SPECIFICALLY FOR INFORMATION AND LINKS RELATING TO THIRD-PARTY RETAILERS, WE DO NOT WARRANT THE ACCURACY OF BOOK DESCRIPTIONS, PRICING, AVAILABILITY, OR ANY OTHER INFORMATION PROVIDED BY OR ON BEHALF OF SUCH THIRD-PARTIES.

FOR ANY DIGITAL BOOKS SOLD DIRECTLY BY Hello Favors, LLC IN THE FUTURE, ANY WARRANTIES WILL BE AS EXPRESSLY STATED IN THE TERMS OF SALE APPLICABLE TO THAT SPECIFIC TRANSACTION.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Hello Favors, LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service, including Third-Party Retailers;
  • Any content obtained from the Service, including information about Digital Books;
  • Issues arising from the purchase, download, or use of Digital Books from Third-Party Retailers;
  • For Digital Books purchased directly from DimePath in the future, our liability will be limited as set forth in the specific terms of sale for that transaction, and in no event will exceed the purchase price paid by you for the Digital Book in question;
  • Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

10. Indemnification

You agree to defend, indemnify, and hold harmless Hello Favors, LLC and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

11. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States (or your LLC's jurisdiction), without regard to its conflict of law provisions. You should replace "State of California, United States" with the actual jurisdiction of Hello Favors, LLC.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect by posting the new terms on this page and updating the "Last Updated" date. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
